Rental Terms and Conditions

    1. Rental Terms

    AYTU Otomotiv A.Ş. (hereinafter referred to as the "LESSOR") rents the vehicle specified in this agreement to the "LESSEE" for the duration stated in the contract, provided that the conditions below are met. The LESSEE agrees to return the vehicle on the specified date and time, at the specified location, in the same condition. The LESSEE may extend the rental period with the LESSOR’s approval by notifying at least 24 hours in advance and paying the necessary deposit. Unauthorized extensions are considered as unlawful possession by the LESSEE.

    2. Contact Information and Notification

    The LESSEE agrees that any administrative or legal notifications related to this agreement will be sent to the address/email address provided by the LESSEE and will be considered valid, with no objections.

    3. Authorized Drivers

    The LESSEE cannot allow third parties to drive the vehicle without the LESSOR’s approval. If an additional driver is to be added, their identification, address, and driver’s license information must be recorded in the agreement, and an additional service fee must be paid. The additional driver is equally responsible for the vehicle, even if their signature does not appear on the contract.

    4. Vehicle Condition and Return

    The LESSEE agrees to return the vehicle, including the spare tire, documents, accessories, and equipment, in the same condition as received, at the date specified in the contract. In case of loss, the LESSEE is responsible for covering the costs of replacement.

    5. Minimum Rental Period

    The minimum rental period is 24 hours. Even for rentals shorter than this period, a one-day rental fee will be charged. If the vehicle is returned late, a full day’s rental fee will be charged for delays exceeding two hours.

    6. Vehicle Pickup and Drop-off

    Vehicle pickup and drop-off are conducted at AYTUCAR offices during business hours. The LESSEE may purchase additional services such as one-way rental, delivery/pick-up to a specified address, GPS, Wi-Fi, child seat, after-hours service, extra kilometers, and additional insurance.

    7. Responsibility for Items Left in the Vehicle

    The LESSOR is not responsible for any items left in the vehicle after it is returned. The LESSEE releases the LESSOR from any claims related to such items.

    8. Payment and Default

    If the rental fee is not paid, the LESSOR reserves the right to request a precautionary lien or an injunction. The LESSOR may use a tow truck or spare keys to recover the vehicle. The LESSOR is not responsible for valuables inside the vehicle during towing.

    9. Insurance Coverage

    The rented vehicle is covered by CDW (Collision Damage Waiver), fire, and theft insurance in accordance with the terms specified by the Turkish Insurance and Reinsurance Companies Association. Passengers are covered by Personal Accident Insurance (PI) within the limits of the Compulsory Traffic Insurance. Any damage exceeding the insurance limits is the responsibility of the LESSEE.

    10. Deposit Policy

    A deposit amount, which varies by vehicle group, must be secured from the LESSEE’s credit card at the start of the rental. The credit card must be in the LESSEE’s name and must be enabled for online transactions. Debit and Dinner cards are not accepted.

    11. Smoking Policy

    Smoking is prohibited inside the vehicle. Any cleaning costs resulting from smoke odor, stains, or burns will be charged to the LESSEE.

    12. Termination by the Lessor

    The LESSOR has the right to terminate the rental agreement unilaterally without providing any justification.

    13. Request for a Second Credit Card

    The LESSOR reserves the right to request a second credit card if necessary. The LESSOR also has the discretion to deny vehicle rental if the credit card authorization cannot be secured.

    14. Payment of Tolls, Fines, and Fees

    The LESSEE is responsible for paying all tolls, bridge, tunnel, and parking fees, as well as any traffic fines incurred during the rental period. These fees may be charged to the LESSEE’s credit card after the rental period.

    15. Prohibited Use and Legal Compliance

    The LESSEE agrees not to use or allow the vehicle to be used for the transportation of items considered illegal under Turkish laws, including customs and firearms regulations.

    16. Situations Excluding Insurance Coverage

    Insurance coverage will be void in the following cases:

    • Use of the vehicle by anyone not listed in the rental contract.

    • Use of the vehicle under abnormal conditions (overheating, poor road conditions, driving on a flat tire, incorrect fuel).

    • Violation of traffic rules (exceeding speed limits, running a red light, etc.).

    • Driving under the influence of alcohol or drugs.

    • Negligent or reckless driving (failing to adjust speed in rainy conditions, following too closely, or driving on unsuitable roads).

    • Failure to notify the LESSOR immediately in case of an accident or theft.

    • Leaving the scene of an accident (except for a medical emergency).

    • Failure to obtain the necessary reports (accident report, alcohol report).

    • Leaving the vehicle unlocked, leaving the keys inside, or handing over the keys to unauthorized persons.

    • Damage caused by items carried inside the vehicle.

    • Using the vehicle for transporting passengers or goods for profit.

    • Damage during valet service or towing.

    • Lost or damaged keys.

    • Damage to tires, windows, headlights, or rims without an associated accident (this coverage can be purchased separately).

    • Damage to the seats or upholstery caused by stains, burns, or tears.

    • If the insurance company pays damages to the other party and claims reimbursement from AYTUCAR, the LESSOR reserves the right to claim the same amount from the LESSEE.

    17. Optional Insurance Coverages

    The LESSEE can purchase the following additional coverages:

    • (MI) Mini Damage Protection: Coverage up to 7,500₺ for damages without the need for a police report.

    • (SCDW) Super Damage Protection: Coverage up to 12,500₺ for damages without the need for a police report.

    • (LCF) Tire, Glass, Headlight Protection: Coverage for tire, glass, headlight, and rim damage unrelated to an accident.

    18. Jurisdiction

    Any disputes arising from this agreement will be settled in the Courts and Enforcement Offices of Antalya.
